Utah Liquor Laws and Gratuities

bulletYou must be 21 to buy or consume alcoholic beverages in Utah. Alcoholic beverages are available in two ways in this state - by the glass or by the bottle.
 
bulletMixed drinks and wine may be ordered with food in most restaurants from noon to 1 a.m., and beer may be ordered from 10 a.m. to 1 a.m. Patrons may be served at their tables or in waiting areas. Drink menus and wine lists are provided only upon request, so you must ask your server for such a list. Likewise, servers are prohibited by law to ask patrons if they would like an alcoholic beverage; the request must be made by the patron. 
 
bulletRules are more relaxed in Utah's non-exclusive private clubs. At these establishments, patrons must purchase memberships or be sponsored by a club member. Mixed drinks, beer, and wine may be ordered Monday through Saturday from 10 a.m. to 1 a.m. and on Sundays and holidays from noon to 1 a.m. You may obtain a drink in a private club with or without food, and patrons may be served at the bar or at tables. Although private clubs are primarily for members, most clubs offer temporary "visitor" memberships for a nominal fee (usually $5 for two weeks, which allows a visitor and up to five of his or her guests to use the club).
 
bulletTaverns and a number of other venues, such as lounges, cabarets, nightclubs, cafes, bowling centers, and golf centers, sell only beer. Sales are allowed from 10 a.m. to 1 a.m. Beer may be purchased without ordering food and is sold on draft and in bottles and cans. Beer sales "to go" are also allowed, but it is illegal to carry open containers outside of an establishment. The maximum alcohol content in beverages sold at these establishments is 4 percent by volume or 3.2 percent by weight.

bulletUnopened packaged liquor, wine, and heavy beer for off-premise consumption are sold at state liquor stores throughout Utah. The state liquor store in Moab is located at 55 West 200 South. The Moab store is open Monday through Saturday; it is closed on Sundays and holidays. May 1 to October 31, store hours are 11 a.m. to 9 p.m. November 1 to April 30, store hours are 11 a.m. to 7 p.m. State liquor stores accept cash, checks, and credit cards. Cork-finished bottles of wine may also be purchased at the two wineries in our area. 

Utah law forbids open containers in any motor vehicle. A blood alcohol level of .08 percent is the maximum allowable under Utah Code; a person having that percentage or higher will be charged with driving under the influence.

Gratuities

In resort/vacation areas, it is common practice for some restaurants to add a set service amount for any large parties (usually 6 or more) as well as an approximate 15% service charge to foreign parties of any size. This practice came about to aid foreign travelers who were unclear about the policies of "service included" in a ticket total (as is common practice in Europe).
